Thomas RIMELL

In the name of god amen I Thomas Rimell the elder of Weston Subedge in the County of Gloucester, gentleman do hereby revoke all wills, codicils and other testamentary dispositions made by me at any time or times heresofore and publish and declare this to be my last will and testament.

My will and mind is that I be decently and privately buried at the discretion of my executors. I direct all my just debts and funeral expenses and legacies given by this my will or any codicil thereto or by any writing signed with my hand unless I shall expressly direct the contrary or change the same on any of my real estates specifically to be paid with all convenient speed after my decease by with and out of my personal estate but if that shall be insufficient to discharge the same I charge my real estate with the deficiency.

I give and devise all those two Messuages Cottages Tenements and one yard and one quarter of one yard land of arable meadow and pasture with the Appurtenances. Also one Clove or inclosed pasture ground with the appurtenances to the said Messuages Cottages or tenements belonging and appertaining situate lying and being within the town fields and precincts of Weston Subedge aforesaid in the said County of Gloucester now in my own occupation. And also one quarter of one yard land of arable land meadow and pasture situate lying and being within the liberties fields and precincts of Weston Subedge aforesaid now in my own occupation. And also all those four messuages Cottages or tenements and a blacksmith's shop situate lying and being in Weston Subedge aforesaid now or late in the several occupations of John Haines, John Harber, John Maids and Elizabeth Butler with the respective appurtenances to the last mentioned hereditaments belonging and all my equity of redemption estate right title and interest in all and singular my said Messuages Cottages lands tenements and hereditaments before mentioned unto my eldest son Thomas Rimell his heirs and assigns to hold to and to the use of him the said Thomas Rimell his heirs and assigns forever.

I give and devise all that my freehold estate situate lying and being in the parish of Saintbury in the County of Gloucester commonly called or known by the name of Ruberry Ground with the appurtenances thereto belonging unto my second son John Rimell his heirs and assigns to hold the same unto and to the use of him the said John Rimell his heirs and assigns forever subject to and charged and chargeable with the payment of the legacy or sum of fifty pounds to be paid within twelve months after my decease to Hannah the wife of William Smith of Weston Subedge aforesaid, farmer to and for the sole and separate use of the said Hannah Smith .

I give and devise all that my freehold estate situate lying and being in the parish of Mickleton in the said County of Gloucester consisting of two Messuages and an orchard now in the tenure of George Tomes with their appurtenances unto my third son Richard Rimell his heirs and assigns to hold the same unto and to the use of the said Richard Rimell his heirs and assigns forever subject nevertheless to and charged and chargeable with the payment of the further legacy or sum of fifty pounds to be paid within twelve months after my decease to the said Hannah the wife of the said William Smith to and for the sole and separate use of her the said Hannah Smith.

I give and devise all that my freehold Messuage or tenement and Cherry orchard to the same belonging with their and every of their appurtenances and all and singular the premises which I purchased of Thomas Taylor situate in the parish of Weston Subedge aforesaid unto my fourth son Joseph Rimell his heirs and assigns to hold the same unto and to the use of him my said son Joseph Rimell his heirs and assigns forever subject nevertheless to and charged and chargeable with the payment of the legacy or sum of five pounds to be paid within twelve months after my decease to Mary the wife of William Nightingale of the parish of Saintbury aforesaid to and for the sole and separate use of her the said Mary Nightingale.

I give and bequeath unto my son David Rimell the legacy or sum of fifty pounds.

I give and bequeath unto Elizabeth the wife of Henry Drury of Weston Subedge aforesaid, farmer the legacy or sum of fifty pounds to be paid unto her to and for her sole and separate use.

I give and bequeath unto my said son Joseph Rimell the legacy or sum of fifty pounds.

I give and bequeath unto Margaret the wife of John J__ of the parish of Bradfordton in the County of Worcester, shoemaker the legacy or sum of fifty pounds to be paid unto her to and for her own sole and separate use.

And my will and mind is that the duty on legacies for and in respect of the several legacies respectively charged given and bequeathed in and by this my will shall be paid and satisfied by my executors hereinafter named by with and out of my personal estate so that the said Hannah Smith and the several other legatees in my will named shall and may respectively have and receive the whole of their respective legacies free from all deductions and abatements whatsoever and as to for and concerning all my stock household goods furniture and personal estate and effects of what nature or kind soever monies and securities for money or the residue there of which shall remain after the payment satisfaction and discharge of my just debts funeral expenses legacy duties and the several and respective legacies not charged upon any of my real estate I do hereby give and bequeath the same unto my said sons and daughters to be equally divided amongst them share and sharealike.

And I do hereby appoint my said sons John Rimell and David Rimell the executors of this my will in witness whereof I have to this my will contained in three sheets of paper to the two first sheets thereof set my hand and to this third and last sheet set my hand and seal this third day of may in the year of our Lord one thousand eight hundred and nine.
